On termination, provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will continue to apply.

11. Disclaimers of Warranty

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the Service will be error-free or that it will meet your specific requirements.

12. Limitation of Liability

To the fullest extent permitted by law, AAAI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless AAAI and its affiliates from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which AAAI is organized, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through an in-product notice and update the Effective Date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
